LEGAL
Partner Program Terms
These terms govern the creator partner program of I start Monday. Read them before you get a code.
1. Agreement and eligibility
These Partner Program Terms ("Partner Terms") are an agreement between you and IStartMonday, Inc., a Delaware corporation, doing business as I start Monday ("we", "us"). They apply when you click to accept them and join the creator partner program (the "Program"). They add to our Terms of Service and Privacy Policy, which also apply to you. If these Partner Terms and the Terms of Service conflict about the Program, these Partner Terms control. When you accept, we record the version of these Partner Terms and the time.
Anyone with an I start Monday. account can join. You must be at least 18 and legally able to enter into this agreement. If you join for a company or a channel, you represent that you may bind it. There is no application, no review, and no minimum audience. We may still suspend or remove a creator as described in section 14. We do not promise that you will earn anything.
In these Partner Terms, "creator" means you. "Code" means a creator code issued to you. "Link" means a web address that carries your code, such as https://istartmonday.com/?via=YOURCODE. "Referred Account" means an account that is attributed to you under section 4. "Dashboard" means the partner area of your account.
2. How the Program works
You enter at least one social link or handle (YouTube, TikTok, Instagram, or another), accept these Partner Terms, and get a code at once. You share your link or say your code. When a new account signs up with your code, that account gets bonus credits and you earn commission on what the account pays us. Your Dashboard shows clicks, sign-ups, each Referred Account, payments, commissions, and payouts. We do not check or verify the social links you enter.
The main rules at a glance. The sections below are the full rules.
| Item | Rule |
|---|---|
| Commission | 30% of what a Referred Account pays us, after discounts and excluding taxes, for the life of the account while the Program runs (section 3) |
| Bonus for new accounts | 10 extra credits for an account that signs up with your code (section 5) |
| Which sign-ups count | New accounts only, through your link or by typing your code. The last code stored within 60 days counts. The code must be claimed within 7 days after the account is created (section 4) |
| Hold | A commission is on hold for 30 days after the payment it comes from (section 6) |
| Payouts | Once a month, by hand, to PayPal or Zelle, when your available balance is at least 20 USD (section 7) |
3. Commission
You earn 30% of every payment a Referred Account makes to us for purchases, for as long as that account exists and the Program runs.
Commission is calculated on the amount the account actually paid after discounts and promo codes, not counting sales tax or similar taxes we collected. We do not subtract our payment processing fees or other costs. Free, promotional, bonus, and referral credits earn no commission, and neither does spending credits. Commission arises only when money is paid. It is rounded to the nearest cent, with half a cent rounded up. All amounts are in US dollars.
The rate shown in your Dashboard is the rate that applies to you. We may change the rate, for all creators or for you alone, for payments made after the change. A payment earns commission at the rate that applied when the payment was made.
Our records decide which sign-ups, payments, and commissions count, and your Dashboard shows them. If you think something is wrong, write to support@istartmonday.com. We will review it and correct errors.
4. Which sign-ups count
A sign-up counts for you only when all of these are true:
- The account is new. An account that existed before your code was applied cannot be attributed to you.
- The person opened your link and the code was stored in their browser, or they typed your code into the sign-up form. A code from a link stays in the browser for up to 60 days. If more than one code is stored, the last one wins.
- The code is claimed within 7 days after the account is created.
- The account is not excluded by section 9, for example as a self-referral.
Each account has one creator for the life of the account, and this cannot be changed afterward. A creator code and a friend referral do not combine: whichever is claimed first is the only one that applies to the account. We cannot add your code to an account after the 7 days have passed, even if the person says they used your link.
A code can be lost when a person clears browser data, switches browser or device, uses private browsing, or blocks storage. We do not promise to credit every sign-up you influence.
You get one code when you join. You may create more, up to 10 in total. A code is 4 to 16 letters and digits. It must not be a reserved word, and it must not already exist as a creator code, a friend referral code, or a promo code. A code is never deleted or renamed, because it may already be in a video or a post. We may disable a code that is misleading, infringes someone's rights, or breaks these Partner Terms. A disabled code stops working for new sign-ups.
5. The bonus for new accounts
A new account that signs up with your code gets 10 extra credits, on top of the free credits every new account gets. They are general credits that can be used for any document. They follow the credit rules in the Terms of Service: they are valid for 6 months from the date they are granted, they are non-transferable, and they have no cash value. Each account gets the bonus once.
We may change or end the bonus for future sign-ups. Describe the bonus only as it is shown in your Dashboard at the time you speak or post. The bonus is for the new account. It is not paid to you.
6. Hold, reversals, and negative balances
Each commission is on hold for 30 days after the payment it comes from. After that it is available and counts toward your payout.
We reverse a commission when the payment it comes from is refunded, disputed, or charged back, or when we find that it was tied to fraud or abuse. A refund reverses the matching share of the commission: a refund of half the payment reverses half of the commission. A dispute or chargeback reverses the whole commission on that payment when the dispute is opened. If we win the dispute, we may restore the commission. Under the Terms of Service, a customer can ask for a refund within 7 calendar days after purchase if none of the purchased credits has been used, and in other cases where law requires it or the Service failed to deliver. A reversal can happen after the hold has ended.
A reversal can make your available balance negative. We carry a negative balance forward and subtract it from your future commissions before any payout. We do not ask you to pay back a payout that was already made, except an amount tied to fraud, abuse, or a breach of these Partner Terms.
Your Dashboard shows three amounts. "On hold" is commission that is still inside its 30 days. "Available" is commission past the hold, minus reversals and minus what we have already paid you. "Paid out" is the total we have paid you.
7. Payouts
We pay once a month, by hand. We do not promise a specific day of the month. We pay in US dollars to PayPal or Zelle. You choose the method in Settings and give us a correct e-mail address or phone number for it.
We pay only when your available balance is at least 20 USD at the time of the monthly payout. A smaller balance carries over to the next month. We record each payout in your Dashboard.
You are responsible for the payout details you give us. If they are wrong, we are not responsible for a payment sent to them and may not be able to get it back. If a payout is returned, it goes back to your available balance. Fees, currency conversion, and limits charged by your own PayPal, bank, or other provider are yours.
We may delay a payout while we investigate suspected fraud or abuse, while we wait for a tax form under section 8, or when the law does not allow us to pay you, including under sanctions rules. We may add or remove payout methods, with notice in your Dashboard or by e-mail.
Commission is not wages or a salary. We pay no interest on balances.
8. Taxes
You are responsible for all taxes on what you earn from the Program. We do not give tax advice. We may ask you for a tax form, such as IRS Form W-9 or Form W-8BEN, before we pay you or at any time after. We may hold your payouts until you provide it. We may report payments to tax authorities, and withhold from a payment, where the law requires.
9. Rules for creators
You must follow the law, the rules of every platform where you promote, and the rules below. You must not:
- Refer yourself or anyone you control, or use more than one e-mail alias of the same mailbox, to collect the bonus or commission.
- Create fake, duplicate, automated, bought, or incentivized accounts. Do not offer money, gift cards, rebates, or other rewards, other than the bonus in section 5, in return for signing up or buying.
- Buy search ads on our brand terms. That includes "I start Monday", "istartmonday", and close misspellings.
- Post your code or link on coupon or deal sites, or register domains, handles, or pages built around our name plus coupon or discount words, to catch people who are already looking for us. Do not use browser extensions, pop-ups, redirects, hidden links, or software that put your code in a visitor's browser without the visitor choosing to follow it.
- Send spam, meaning unsolicited bulk e-mail, texts, direct messages, comments, or forum posts.
- Impersonate us, or say or suggest that you are our employee, agent, or official representative, or that we endorse you beyond your being a creator in the Program. Do not register domains, handles, or app names that look like ours.
- Make claims that break section 10.
- Use automated means to create codes or accounts, open more than one partner profile, interfere with the Service, or get around the limits of the Program.
If you break this section, we may reverse the affected commissions, hold payouts while we investigate, disable codes, and suspend or remove you. Commission that comes from fraud, abuse, or a breach of this section or section 10 may be forfeited.
10. Disclosure and what you may say
You must tell your audience clearly that you earn a commission. Follow the FTC Endorsement Guides (16 CFR Part 255) and similar laws wherever your audience lives. Put the disclosure where people see or hear it, next to the link or the code and in the same format as the promotion. In a video, say it aloud. In a post, put it in the visible text, not only on a profile page or in a link list. Plain words such as "I earn a commission if you sign up and pay" or "#ad" work. Use the disclosure tools of the platform too, where it has them.
You may say only accurate things about I start Monday. Describe the product as it is described on our website. Say you have used it only if you have. Do not promise or suggest jobs, interviews, offers, raises, or any other result for a user. Do not say that a document is guaranteed to pass an applicant-tracking system or satisfy an employer. Do not give legal or immigration advice in our name. Do not state or suggest what you or other creators earn or will earn from the Program. Describe the bonus as it is shown in your Dashboard, and do not say it is more than that.
Do not make statements in our name. If something you said is wrong or misleading, correct it or remove it promptly when we ask.
11. Use of our brand
We give you a limited, revocable, non-exclusive, non-transferable license to use the name I start Monday, our logo, and the brand materials we provide, only to promote the Service under these Partner Terms. Do not change our logo, and do not use names, domains, handles, or designs that could be confused with ours. We own the brand and everything built on it. We may withdraw this license at any time by notice, and you must then stop using the brand within a reasonable time. The license also ends when you leave the Program or are removed from it.
12. Information you can see
For each Referred Account, your Dashboard shows:
- a masked e-mail address: the first and last characters of the name before the @ and the full domain, for example da***iy@gmail.com
- the sign-up date
- whether the account has made a first document or a purchase
- the number of documents generated, by type
- the date of last activity
- the dates and amounts of purchases and refunds, with your commission
It never shows the person's name, full e-mail address, documents, profile, searches, or the content of anything they made.
This information is confidential. Use it only to understand your own results and your own earnings. Do not try to identify or contact a Referred Account with it, including by matching it with e-mail domains, follower lists, or other data. Do not publish, sell, share, or combine it with other data, and do not use it to market to anyone. You may share your own totals, but not the list of accounts. We handle personal information as described in the Privacy Policy.
13. Independent contractor
You are an independent contractor. Nothing in these Partner Terms makes you our employee, agent, partner, joint venturer, or franchisee. You decide when, where, and how to promote, and you pay your own costs. You may not make promises, sign anything, or make statements for us. We may promote other products and work with other creators.
14. Suspension, changes, and ending the Program
You may leave the Program at any time by e-mailing support@istartmonday.com. We may suspend you, disable your codes, or remove you from the Program at any time, including for a breach of these Partner Terms, fraud, legal or reputational risk, or a security concern. When reasonably possible, we will give notice and, for a breach that can be fixed, a chance to fix it.
While you are suspended, your Dashboard is read-only, your codes do not work for new sign-ups, and no new commission is earned. After you leave or are removed, commission you had already earned, including commission still on hold, stays payable under these Partner Terms (after the hold, reversals, and the 20 USD minimum), unless it comes from fraud, abuse, or a breach of section 9 or 10.
We may change these Partner Terms, the commission rate, the bonus, the hold, the minimum payout, or the payout methods, or end the Program. We will give notice in your Dashboard or by e-mail. A change applies to payments made after its effective date and does not reduce commission you have already earned. If you keep using your code after the effective date, you accept the change. If you do not accept it, stop promoting and tell us.
If you delete your account, we suspend your partner profile and erase your social links and payout details. Commission and payout records stay in our books, as described in the Privacy Policy. If you have an available balance, contact support before you delete your account.
15. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT GUARANTEE THAT YOU WILL EARN ANY COMMISSION, THAT ANYONE WILL SIGN UP OR BUY, THAT ANY SIGN-UP WILL BE ATTRIBUTED TO YOU, OR THAT THE PROGRAM WILL CONTINUE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER I START MONDAY. NOR ITS SERVICE PROVIDERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, AUDIENCE, OPPORTUNITIES, OR GOODWILL, ARISING FROM THE PROGRAM. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE PROGRAM WILL NOT EXCEED THE GREATER OF 100 USD OR THE COMMISSION PAID OR PAYABLE TO YOU IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. This limitation does not reduce commission that is earned and payable under these Partner Terms. It does not apply to fraud, willful misconduct, obligations that cannot legally be limited, or where the law prohibits it.
16. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless IStartMonday, Inc., doing business as I start Monday, and its affiliates, officers, directors, employees, and agents from third-party claims and government actions arising from your promotion, your statements, your failure to make a required disclosure, your breach of these Partner Terms, or your violation of law or of another person's rights. We will promptly notify you and allow reasonable control of the defense, subject to our right to participate.
17. Governing law and disputes
Before filing a claim, either party must send a written notice describing the dispute and requested resolution to support@istartmonday.com and allow 30 days for a good-faith informal resolution. This requirement does not prevent either party from seeking urgent injunctive relief or filing an eligible claim in small claims court.
California law governs these Partner Terms, without regard to conflict-of-law rules, except to the extent the law of your residence gives you non-waivable rights. Subject to the preceding informal process, any court proceeding must be brought in the state courts located in Santa Clara County, California, or the federal courts with jurisdiction there. We are not requiring arbitration and these Partner Terms do not include a class-action waiver.
18. General terms and contact
These Partner Terms, the Terms of Service, and the Privacy Policy are the entire agreement about the Program. If a provision is unenforceable, the remainder continues to apply. A failure to enforce a provision is not a waiver. You may not assign these Partner Terms without our consent; we may assign them in connection with a reorganization, financing, merger, or sale, subject to applicable law. Neither party is liable for delay caused by events beyond reasonable control. Sections that by their nature should continue after the Program ends, including sections 6, 8, 12, and 15 to 17, continue to apply. Headings are for convenience only.
Notices to you may be sent to your account e-mail or posted in your Dashboard. Contact IStartMonday, Inc., doing business as I start Monday, at support@istartmonday.com or 2260 Homestead Ct, Unit 205, Los Altos, CA 94024.
